yay civil law in a conlaw class....

best-spent class EVER

80% of cases are denied certiorari basically out of hand
nearly all the rest are denied cert through lack of justice votes
cases go into queue when accepted by the justices, basically are never pruned out
if they take more cases than they can handle, they just go to next year
why is this an acceptable system?
-because it works reasonably well, considering the amount of work done by the justices (or lack thereof)
arguments against the system?
-unduly favors the solicitor-general
-not only does he get heard much much more often than anybody else, but he also wins more often
-suggestion- make certiorari the province of not the supreme court, but of some other body
-if congress ever did this, it'd be a HUGE seperation of powers issue
